Adoption Contract

This is our standard adoption contract that must be completed and signed by anyone wishing to adopt an animal from the Hillside SPCA. Our number one concern is for the animals and we strive to place them in good, loving homes.

  • NOTE: Application for adoption does not guarantee acceptance for adoption. Hillside SPCA reserves the right to accept or deny any application or potential adopter.
  • NOTE: All current and former pets in a household must be/were spayed/neutered and up-to-date on vaccines before any adoption will be considered for approval.

 

 

HILLSIDE SPCA, INC. FELINE ADOPTION CONTRACT

  1. I understand and agree that Hillside SPCA, Inc. (hereafter referred to as “Hillside”) cannot guarantee the health, temperament, behavior, survivability or training of any animal. I understand and acknowledge that animals may behave in ways that are not always predictable and that Hillside has made no warranties of the future condition, temperament or conduct of this cat.  I accept this cat “as is”- assuming all risks and responsibilities that accompany pet ownership, including scratching and biting.  I understand that I am adopting a rescued pet which may have health issues that Hillside is unaware of and I accept all responsibility including medical bills after adoption.
  2. The above described animal is being adopted by me solely as a pet for myself and/or my immediate family.  All individuals residing at my address provided on the application I completed have agreed to the adoption of the animal and all family members will abide by the terms of this contract.
  3. I agree that the cat will be kept only as an indoor, domesticated house pet.  Cats will be kept indoors at all times unless a screened-in porch or similar type enclosure is available.
  4. I agree to take the adopted cat to a veterinarian within the next 30 days (7 days for kittens under 6 months of age) for a general check up, at my expense.  I will keep my cat current on all required and recommended  vaccinations.  I agree to take my cat to a veterinarian for annual visits and to provide veterinary care when my cat becomes sick.  I understand that yearly costs of pet ownership may exceed $600 per year.  As the adopter, am responsible for all veterinary costs.  I understand and agree that Hillside SPCA is not responsible for any veterinarian bills that may be incurred in the future.  I agree to assume all financial responsibilities and costs associated with the physical and emotional health and well-being of the cat for the remainder of the cat’s lifespan.
  5. I have never been subject to legal action for cruelty to or neglect of animals.  I have never owned an animal which has been confiscated by any animal control or humane organization for violations of state or local animal control regulations or animal adoption agreements.
  6. If for any reason I am unable to keep the cat, I understand that I must return the cat to Hillside. I will contact Hillside by phone or email (kdhadopt34@gmail.com).  I agree to give Hillside SPCA, Inc. reasonable time to find available cage space and understand that this may take weeks.  I agree not to abandon, give away, sell, transfer or dispose of this cat in any way.  I agree that I may never surrender the cat to another shelter or rescue.  I agree I may not euthanize the cat except in the case of severe behavior issues, terminal illness, injury, or old age accompanied by pain and suffering.  Should the aforementioned conditions be met, I understand and agree that the euthanasia must be performed by a veterinarian in a private clinic or hospital.
  7. I understand and agree that Hillside retains the right to perform home checks at its discretion, and shall have the right of immediate possession of the animal if, in the judgment of Hillside, the animal is receiving inadequate care or is being improperly housed or handled.  
  8. I agree to pay Hillside the sum of $1,000.00 as liquidated damages in the event any terms or conditions of this contract are breached; this liquidated damage value does not bar Hillside from seeking the return of the animal by judicial process or other legal means if necessary.  If legal action is instituted, I agree to pay attorney’s fees and court costs associated with said action.
  9. I understand that there will be NO REFUNDS OF ADOPTION FEE.
  10. I agree that I will never declaw, or allow the declawing of the adopted cat.  I understand and acknowledge that breach of this clause will result in the immediate termination of this contract, and ownership will be relinquished to Hillside SPCA, Inc, without the right to reclaim possession of the cat. In addition, Adopter agrees that without the right to reclaim possession of the cat.  In addition, Adopter agrees that liquidated damages in the amount of $3,000, as well as attorney’s fees and court costs, will be paid to Hillside SPCA in the event of said breach.
  11. I acknowledge that dependent upon the age of the cat I am adopting, that this cat may not have been tested for feline leukemia virus (FeLV) or feline immunodeficiency virus (FIV).  It is Hillside’s policy that cats be at least six (6) months of age to be tested.  All medical testing and treatments are located in the medical records you have received with your adoption paperwork.  I understand that it is my responsibility to have this cat tested if it has not been tested yet.
  12. I acknowledge that I have received a copy of the Hillside SPCA, Inc. Animal Adoption Contract Terms.

I hereby accept possession of, title to (subject to the conditions of the adoption contract), and responsibility or the animal identified above and hereby release and discharge the Hillside SPCA, Inc. forever from liability for any injury or damages to any person or property caused in the future by said animal, and from any causes of action, claims, suits or demands whatsoever that may arise as a result of such injury or damages.

 

 

HILLSIDE SPCA, INC. CANINE ADOPTION CONTRACT

  1. I understand and agree that Hillside SPCA, Inc. (hereafter referred to as “Hillside”) cannot guarantee the health, temperament, behavior, survivability or training of any animal. I understand and acknowledge that animals may behave in ways that are not always predictable and that Hillside has made no warranties of the future condition, temperament or conduct of this dog.  I accept this dog “as is”- assuming all risks and responsibilities that accompany pet ownership, including scratching and biting.  I understand that I am adopting a rescued pet which may have health issues that Hillside is unaware of and I accept all responsibility including medical bills after adoption.

  10. I agree to license the dog in compliance with the laws and ordinances enforced in the municipality in which I reside.
